B-Sides, a trading name and registered trademark of Burn The Boats Limited (company number: 13651217) a legal entity (“B-Sides”, “us”, “we”, or “our”) operates the website (hereinafter referred to as the “Service”). Please carefully read this page, which informs you of our policies regarding the collection, use and disclosure of personal data when you use our Service and the choices you have associated with that data. We use your data to provide and improve the Service. By using the Service, you agree to the collection and use of information in accordance with this policy.

1. Definitions

Service is the website domain.

6. Legal Basis for Processing Personal Data under the General Data Protection Regulation (GDPR)

  1. In providing our products and services, or collecting and using your personal data, we are required to comply with the GDPR where you are a European Union resident. If you are a resident of the European Union for the purposes of the GDPR, then in addition to what is set out in Sections 1-5 above, the following applies to you. Under the GDPR, we are considered a “data processor” in the provision of our retail services to you.

    1. (access) request access to your personal data held by B-Sides;
    2. (rectification) request to update or rectify any of the personal data that we hold about you by contacting us at the details specified above and request personal data updates;
    3. (erasure) withdraw your consent to B-Sides’s use of your personal data as described in this policy by deletion or erasure of your personal data that we hold where that data is no longer required for the purpose for which it was collected;
    4. (restriction on processing) obtain from the controller (usually, this is your employer) a restriction on processing of your personal data where:
      1. accuracy of the personal data is contested;
      2. the processing by the processor is unlawful (and you oppose erasure but request restriction of use);
      3. B-Sides no longer needs your personal data; or
      4. you have objected to processing pursuant to your right to object under Article 21(1) of the GDPR;
    5. (data portability) request that B-Sides:
      1. provides you with a copy of the personal data that B-Sides holds about you in a portable and machine readable form; or
      2. share your personal data with a nominated third party.
  4. If you wish to exercise any of your data subject rights, then please send your request in writing to the details below in section 12.1. We will process your request promptly and in any event, within one month of receipt of receiving it.
  5. If you have any concerns in relation to B-Sides’s collection or processing of your personal data, then you also have a right to complain to a supervisory authority (within the meaning of the GDPR).

7. Retention of Data

B-Sides will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies. B-Sides will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer periods.

8. Transfer of Data

Your information, including Personal Data, may be transferred to – and maintained on – computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. B-Sides will take all the steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information.

Disclosure for Law Enforcement. Under certain circumstances, B-Sides may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Legal Requirements B-Sides may disclose your Personal Data in the good faith belief that such action is necessary to:

To protect and defend the rights or property of B-Sides
To prevent or investigate possible wrongdoing in connection with the Service

These Services providers include but are not limited to website service providers or email outreach tools such as Mailchimp. These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

12. Analytics

We may use third-party Service Providers to monitor and analyse the use of our Service including Google Analytics. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualise and personalise the ads of its own advertising network.You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. The add-on prevents the Google Analytics JavaScript (ga.js, analytics.js and dc.js) from sharing information with Google Analytics about visits activity. 13. Children’s Privacy

Our Service does not address anyone under the age of 18 (“Children”). We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your Child has provided B-Sides with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

14. Changes to This Privacy Policy

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page. We will let you know via email and/or a prominent notice on our Service, prior to the change becoming effective and update the “effective date” at the top of this Privacy Policy. You are advised to review this Privacy Policy periodically for any changes. Changes to this Privacy Policy are effective when they are posted on this page.
